2026 OCA Dive Waiver

OCA Dive Waiver – Terms & Conditions

In consideration of being permitted to engage in any or all of the following activities on, from, with or at a meeting place or event location of the Old Colony Amphibians Dive Club (OCA), to wit, SCUBA diving, skin diving, swimming, fishing, boating, specimen collecting, and transportation to and from the site (but not limited to these activities):

1. I hereby assume the risk of injury, death or damage to property which I may suffer in the course of engaging in any activity;
2. I hereby release and hold harmless the OCA, its officers, directors, or members from my liability for injury, death or damage to property which I may suffer in the course of engaging in such activities, resulting from any cause whatsoever, including the negligence of the OCA, its officers, directors or members;
3. I hereby agree to indemnify, defend and hold harmless the OCA, its officers, directors and members for and against any claims made against them or any of them by a third party for personal injury, death or property damage arising in any way out of my engaging in such activities;
4. I have read and understood and hereby agree to abide by the OCA club rules as they pertain to this activity, as well as guidance and direction from boat captains, dive buddies, and dive and event organizers;
5. I also agree to abide by laws and regulations of the US Coast Guard, local and state environmental laws and regulations pertaining to boating to boating, fishing and diving, and to use “common sense” pertaining to safety when it comes to boating, fishing and diving;
6. I herby represent that if I engage in the sport of scuba diving with the OCA that I am a certified scuba diver with the appropriate level of training required for the type of diving that I am planning to engage in, that I am healthy, sober and of right mind to engage in such activity. I agree that I will follow the recommended scuba diving best practices and guidance and rules pertaining to safety, will not dive beyond my certification limits, and will dive with a buddy when appropriate; 
7. I understand and agree that I am not only giving up my right to sue the OCA, its officers, directors, or members, but also any rights my heirs, assigns, or beneficiaries may have to sue the OCA, its officers, directors, or members, resulting from my death, injury or property damage. I further represent that I have the authority to do so and that my heirs, assigns, or beneficiaries will be estopped from claiming otherwise because of my representations to the OCA, its officers, directors, or members;
8. I have fully informed myself and my heirs of the contents of this liability release and assumption of risk agreement by reading it before I signed it on behalf of myself and my heirs.
